Legislative amendments on the contribution for failure to achieve the collection targets for electrical and electronic equipment and portable batteries and accumulators
The Law no. 143/2018 regarding the approval of Government Emergency Ordinance no. 48/2017 amending and supplementing the Government Emergency Ordinance no. 196/2005 on the Environmental Fund, postpones the payment of the contribution for failure to achieve the collection targets both by economic operators placing on the market electrical and electronic equipment and portable batteries and accumulators, as well as for the collective organizations, as below:
- from 1 January 2017 until 31 December 2019 for the difference between the quantities of electrical and electronic equipment declared as being placed on the domestic market and the quantities found by the Fund Administration to be placed on the national market;
- as of 1 January 2020, for the difference between the quantities of waste electrical and electronic equipment corresponding to the annual collection obligations, provided in the Government Emergency Ordinance no. 5/2015 on waste electrical and electronic equipment and the quantities actually collected.
Revision of the Posting of Workers Directive – amendments brought to Directive 96/71/EC
EU law defines a set of mandatory rules on employment terms and conditions applicable to posted workers. These rules are defined in Directive 96/71 / EC, adopted in 1996.
Directive 96/71/EC on the posting of workers in the framework of the provision of services was amended by Directive 2018/957/EU, published on July 9, 2018, in order to ensure that a fair balance is struck between the freedom to provide services within the European Union and loyal competition. The Directive 2018/957/EU ensure as well the protection of posted workers during their secondment in the context of the freedom to provide services by laying down mandatory provisions on working conditions and health and safety protection of workers to be respected.
Quarterly dividend payment now possible
Law no. 163/2018 brings a significant change to the law of companies no. 31/1990, by including the possibility of distributing dividends during the year based on quarterly financial statements. The new law came into force on 15 July 2018.
Law no. 176/2018 on internship
Law no. 176/2018 on internship was published on July 19, 2018, the law defines how to implement internship programs for people aged 16 years in order to: develop the professional skills of interns in fulfilling their responsibilities and responsibilities in the field organizing the internship program; conducting activities and familiarizing with the requirements of the host organization; internal knowledge of the specifics of the activity of the host organization in which it operates, as well as its requirements; acquiring professional experience, practical skills and / or skills; facilitating the transition from the education system to the labor market.
VAT exemption for payments and transfers
According to the decision of the Court of Justice of the European Union (CJEU), published on July 25, 2018, in Case C-5/17 DPAS Limited, service providers that only instruct banks to make money transfers cannot apply the VAT exemption for payment transactions.
Form 107 „Informative Statement regarding the beneficiaries of sponsorships/patronages/private scholarships”
Taxpayers granting sponsorship, acts of patronage or private scholarships will have the obligation to submit a new form, annually: Form 107 „Informative Statement regarding the beneficiaries of sponsorship/patronages/private scholarships”, according to Order no. 1825/2018, published in the Official Gazette no. 646 dated July 25, 2018.
